1. Service Description
Ever Services provides professional photo editing services, including but not limited to color correction, retouching, cropping, and enhancement. Our services are available to individuals and businesses worldwide.
2. Payment Terms
Clients are required to pay for services as agreed upon in our pricing structure. We accept payment via PayPal, WISE, and Payoneer. Payment is due upon completion of services, unless otherwise specified in writing. Late payments may incur penalties.
3. Turnaround Time
We strive to complete edits in a timely manner. Turnaround time depends on the complexity of the edits and our current workload. Clients will be provided with an estimated completion date upon submission of their photos.
4. Quality Assurance
We guarantee the quality of our edits and will make reasonable efforts to ensure client satisfaction. If a client is not satisfied with the results, we offer revisions as outlined in our revision policy. Refunds may be provided at our discretion.
5. Intellectual Property Rights
Clients retain ownership of their original photos. By using our services, clients grant us a limited license to edit their photos for the purpose of providing the requested services. Clients are responsible for obtaining any necessary permissions or licenses for third-party content.
6. Confidentiality
We take the privacy and confidentiality of client photos and personal information seriously. Client photos will only be used for the purpose of providing editing services and will not be shared with third parties without consent, except as required by law.
7. Liability and Indemnity
While we strive for accuracy and professionalism, we cannot guarantee that our services will meet all client expectations. We are not liable for any errors, damages, or losses resulting from the use of our services. Clients agree to indemnify and hold us harmless from any claims arising out of their use of our services.
8. Dispute Resolution
Any disputes arising from these terms and conditions will be resolved through negotiation in good faith. If a resolution cannot be reached, the dispute will be referred to mediation or arbitration in accordance with India's laws.
9. Termination Policy
Either party may terminate the agreement by providing written notice to the other party. Any outstanding payments or obligations must be settled upon termination. We reserve the right to suspend or terminate services immediately for violations of these terms.
10. Governing Law
These terms and conditions are governed by the laws of India. Any legal action arising from these terms shall be brought in the courts of New Delhi, India.
11. Changes to Terms
We reserve the right to modify these terms and conditions at any time. Clients will be notified of any changes and are encouraged to review the terms periodically.
